A visão dos Tribunais Superiores sobre a autoria no delito do art. 2º, Ii da Lei n.º 8.137/90
RESUMO
O artigo analisa criticamente a visão dos Tribunais Superiores sobre a autoria no delito do art. 2º da Lei n.º 8.137/90, principalmente o assentado, respectivamente, pelo Supremo Tribunal Federal e o Superior Tribunal de Justiça, no RHC 163334/SC e no HC 399.109. Utiliza-se, para tal, de pesquisa na Jurisprudência dos Tribunais Superiores, Doutrina e a Legislação em vigor, que trarão fundamentos idôneos para reconhecer o acerto da ratio decidendi extraída dos referidos julgamentos.

ABSTRACT
The article deals with the transformation of the Social State into a Criminal State, using the Welfare State in the United States as a model of analysis, and its dismantling at the end of the twentieth century, at the same time as a series of transformations in criminal legislation and in prison policy occurs from the studies of L. Wacquant. It critically analyzes the argument of the dependence of the assisted and the discouragement to work as effects of Welfare, in face of the precariousness of the American labor market. This workfare state does not aim to reduce poverty, but seeks only to reduce the visibility of the poor in the civic landscape. It verifies the contribution of the media treatment given to urban violence to the formation of a feeling of “war against the poor”, also contributing to the increase in public and private spending in the security sector. It investigates the new criminal and penitentiary forms installed, such as the criminalization of survival practices hitherto tolerated, such as small street businesses, and the intensification of repressive policing of these practices. Comparatively, it examines the recrudescence of the prison population in Brazil and investigates its relationship with public policies of social assistance and education of the strata most affected by the criminalization of poverty, conducting a data survey on the profile of the Brazilian prisoner and on the reality and conditions of prison. Notes that the system of deprivation of liberty does not generate significant impacts in reducing crime in the long term, but it does increase the difficulty of accessing opportunities, establishing a guise of social and labor inclusion, in reality having the opposite effect, in addition to maintaining the marginalized class of society in underpaid jobs, without benefits or guarantees, reducing individual expectations of growth and life change.
